1. Acceptance of Terms

By accessing or using vixie.art ("the Service"), operated by Vixie ("we", "our", "us"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.

2. Service Description

Vixie is an AI-powered photo transformation service that allows users to change photos to different styles using artificial intelligence. The Service is available through our website and Chrome Extension. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

3. User Content & Rights

You retain all ownership rights to photos you upload to the Service. By uploading content, you represent and warrant that:

• You own or have the necessary rights to the content
• The content does not infringe on any third party's intellectual property or privacy rights
• You have consent from any individuals depicted in the photos

You grant us a limited, temporary license to process your photos solely for the purpose of delivering the transformation. Photos are processed and immediately deleted — we do not store your images.

4. Prohibited Uses

You may not use the Service to:

• Generate non-consensual intimate or explicit imagery of any person
• Create content that is defamatory, harassing, or threatening
• Produce fraudulent or deceptive content, including deepfakes intended to mislead
• Impersonate another person without their consent
• Violate any applicable local, state, national, or international law
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or attempt to extract the source code of the Service

5. Intellectual Property

The Service, including its design, features, AI models, and underlying technology, is owned by Vixie and protected by intellectual property laws. Nothing in these Terms grants you any right to use the Vixie name, logo, or trademarks without prior written consent.

6. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. AI-generated results may vary in quality and accuracy. We make no guarantees regarding the output of any transformation.

7. Limitation of Liability

To the maximum extent permitted by law, Vixie shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising out of your use of the Service. Our total aggregate liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

8. Termination

We may terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Vixie operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the competent courts of that jurisdiction.

10. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
